A retired Chief State Attorney, Ms Ellen Kwawukume, has dragged the Member of Parliament (MP) for Assin Central, Mr Kennedy Ohene Agyapong, to court for defamation.
She has sued the MP for falsely accusing her of demanding bribe from ace international investigative journalist, Anas Aremeyaw Anas.
Ms Kwawukume is demanding GH¢25 million general damages for libellous and defamatory words the MP published on private media platforms between June and July, 2018.
She said in his campaign dubbed, “Who watches the watchman,” the MP accused her of demanding GH¢5,000 from Mr Anas to badly handle a prosecution.
Other reliefs
Ms Kwawukume is also seeking an order for retraction and apology to be published on all media platforms where she was defamed, as well as other platforms with equal prominence and intensity.
The plaintiff is again praying the court to grant a perpetual injunction restraining Mr Agyapong and his agents from further publishing defamatory materials against her.
Punitive costs and legal fees assessed at the Ghana Bar Association (GBA) scale of fees in operation at the date of judgement and other reliefs the court may deem just and equitable are also being sought.
Joined to the suit as defendants are KenCity Media Limited, Net 2 TV and Oman FM.
Mr David K. Ametefe is the counsel for Ms Kwawukume.

The MP and the SALIS newspaper produced a video documentary titled: “Who watches the watchman,” which sought to project journalist Anas as a corrupt person who demanded bribes to exonerate people he had investigated and found to be corrupt.
The video created the impression that Ms Kwawukume demanded and received a bribe from Anas to stop pursuing a case against people whose interest Anas was serving.
Demand for apology
Ms Kwawukume in July this year demanded a retraction and an apology from the lawmaker.
She said the impression created by Mr Agyapong and the SALIS was false.
Ms Kwawukume at the time served notice that failure to render the apology within seven days would result in a legal action against the MP.
Thus the MP’s failure to retract the claim and apologise has culminated in the lawsuit.

A l’exception de la première exigence, il semble difficile de vérifier les autres conditions dans le cadre d’un entretien téléphonique avec une personne que nous n’avons jamais rencontrée, même si elle se présente sous le titre de « cheikh » ou d’un imam. Donner au malade et à sa famille une leçon de dogme de façon à ce que leurs cœurs ne soient pas attachés à un autre qu’Allah. 6. Leur faire savoir que la façon de soigner est différente de celle des sorciers et des charlatans et que le Coran recèle guérison et miséricorde, comme l’a informé Allah le Puissant et le Majestueux. 7. Diagnostiquer son cas : pour cela poser des questions au malade pour s’assurer de la présence de tous les symptômes (…) ». Nous pouvons à titre d’exemple faire le parallèle avec un rendez-vous chez le médecin ; ce dernier ne peut vous prescrire une ordonnance sans au préalable vous avoir ausculté et interrogé sur les différents symptômes que vous ressentez physiquement. A défaut, au lieu de guérir vous allez aggraver vos maux. Cette attitude vigilante du médecin traitant doit se retrouver lorsque nous envisageons le recours à une « roqya ». Est-ce la gratuité qui a déterminé leur choix ? Certes le mal-être produit par cette société est de plus en plus grand. Nous vivons une époque où les êtres sont de plus en plus coupés des signes de Dieu et vivent un rythme de vie effréné. Ces affaires sont révélatrices des maux les plus profonds qui touchent la communauté musulmane. Par ailleurs, comme l’ensemble des rites islamiques (hajj, halal, pompes funèbres) censés nous rappeler les limites qui déterminent la voie vers Dieu, nous constatons que leur marchandisation trahit de plus en plus leur vocation première. Suffit-il qu’un interlocuteur se présente à nous comme un « cheikh » ou un imam et qu’il nous propose une « roqya » gratuite pour l’accepter aussitôt Ne devrions-nous pas tous nous interroger sur le fait qu’il y ait des musulmanes et des musulmans aussi isolés et aussi ignorants de leur propre religion pour être trompés aussi facilement ?
